Introduction
Welcome to Fix4You, a digital platform operated by Somsed LLC (“Fix4You”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your use of the Fix4You mobile application and related services (collectively, the “Service”). By using the Service, you agree to these Terms and commit to complying with them.
1. Eligibility for Use
Fix4You is available to users of all ages.
Users under 18 may use the Service only with verified parental consent and, where applicable, supervision for certain tasks (e.g., lawn mowing, leaf collection, snow removal).
Users under 13 are not permitted to create an account.
Fix4You assumes no responsibility for transactions involving minors; full responsibility lies with parents or guardians.
2. Platform Description & Functionality
Fix4You connects clients with tradespeople. We are not an employer, contractor, or agent, and we do not guarantee the quality, legality, safety, or outcome of services. We are not responsible for user disputes. Users rate and review each other to provide transparency on service quality.
Note: After both parties confirm a “job agreement” via chat, the rating system becomes available after 48 hours.
3. Account Creation and Responsibilities
You must provide accurate, complete information when creating an account and keep your credentials secure.
You are responsible for all activity under your account.
Fraudulent accounts, identity misuse, or policy violations may result in suspension or termination.
4. Ratings, Reviews, and Complaints
Ratings are public and intended to reflect genuine user experiences. Ratings may be permanent and publicly visible.
Fake, abusive, or fraudulent ratings may be investigated and removed at our discretion.
Complaints can be submitted via the “Customer Support” option in the app or at www.fix4you.app.
5. Content Moderation & Reporting
We provide tools to report inappropriate content and activities. If a listing receives three (3) or more reports, it is automatically hidden until reviewed by our team. Depending on severity, Fix4You may:
Temporarily suspend the user’s account;
Permanently remove the account from the application;
Report the user to relevant authorities.
6. Payments, Credits (Tokens) & Refunds
Fix4You uses in-app credits (“tokens”) for certain transactions.
Android: Payments are processed securely via Stripe. Fix4You does not store card information.
iOS: Purchases are managed via Apple billing (with RevenueCat as our purchase infrastructure).
Refunds: Credits/tokens are non-refundable digital goods. Unused tokens remain in your account until used or your account is deleted. Upon deletion, no refunds or token transfers are provided.
7. Featured Listings & Premium Options
Featured listings remain highlighted for 7 days, then automatically revert to standard listings.
Standard listings are typically visible for 30 days unless renewed or removed.
Users can re-activate featured status anytime by purchasing the appropriate package.
Expired listings may be archived.
8. Referral Program and Promotions
Referral abuse (e.g., fake accounts, self-referrals) may lead to removal of rewards and account suspension.
Rewards may include in-app credits or partner discounts and are subject to change.
9. Membership Plans (Future Feature)
Memberships, when launched, will renew automatically unless canceled via your Google Play or Apple settings.
Once billed, subscription fees are non-refundable for the current period.
10. Data Protection and Privacy
Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and safeguard your information.
11. Limitation of Liability
Fix4You is not liable for user interactions, the conduct of users, or misuse of content or services arranged through the platform.
To the fullest extent permitted by law, our maximum aggregate liability for any claims relating to the Service shall not exceed the total amount you paid to Fix4You in the 12 months preceding the event giving rise to the claim.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles. Nothing in these Terms limits your non-waivable consumer rights under local law.
Before initiating formal action, the parties will attempt to resolve disputes informally. If unresolved, disputes may be submitted to binding arbitration in Delaware or brought in your local small-claims court (if eligible). You and Fix4You waive the right to a jury trial to the extent permitted by law.
13. Changes to These Terms
We may modify these Terms periodically. We will notify users of material changes via email or in-app notifications. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. We encourage you to review these Terms regularly.
